Terms and Conditions

These Terms and Conditions ("Terms") govern your use of VillaForSale.co.in, operated by Starxmart Enterprises. By creating an account, listing a villa, purchasing a subscription, or otherwise using our services, you agree to be bound by these Terms.

1. Subscriptions & Payments

All subscription payments are processed securely via Razorpay. Your subscription is valid for the duration stated in your selected plan (typically 6 months for Silver/Gold/Platinum). Subscriptions auto-expire at the end of the term and are not auto-renewed.

Each plan has its own listing quota: Silver and Gold = 1 listing, Platinum = 2 listings. Quotas are enforced platform-wide and cannot be bypassed.

2. Refund Policy — Platinum Members

Platinum Villa Concierge members are eligible for a 50% money-back refund of the base price after the conclusion of their subscription term, provided all conditions of our integrity check are satisfied. This commitment exists to honour the trust our most premium sellers place in us, while protecting the platform from misuse.

Refund Calculation

The refund is calculated on the base price (pre-GST amount), not the total billed amount. The 18% GST is non-refundable as it has already been remitted to the Government of India.

Platinum total billed: ₹69,999.00

Base price (pre-GST): ₹59,321.19

GST 18% (non-refundable): ₹10,677.81

Maximum refund (50% of base): ₹29,660.60

The refund commitment applies only after the integrity check is satisfied. All four conditions below must be met.

Refund Integrity Check

Before a refund is processed, our team performs the following four-point integrity check. All four conditions must be satisfied for the refund to be approved.

Property must not be sold

The villa listed on VillaForSale.co.in must not have been sold — either through our platform or any external channel — at the time of refund processing. Sale records and registry checks may be requested.

Property must still be in your name

The villa must continue to be legally registered in your name. Additionally, ownership must remain unchanged for a minimum of 30 days after the refund is processed. If the property changes hands within 30 days of refund issuance, the refund becomes recoverable.

No interior work should be in progress

The villa must not have any ongoing interior renovation, remodelling, or construction work at the time of refund. Properties under active renovation indicate intent to use, occupy, or otherwise repurpose the asset, and disqualify the refund eligibility.

Property must not be rented out

The villa must not be given out on rent, lease, or any form of paid occupancy — short-term or long-term — at the time of refund or within 30 days following it. Income-generating use of the property nullifies the refund eligibility.

Refunds are processed within 14 business days of integrity-check approval. To initiate a refund request, email info@villaforsale.co.in from your registered email with the subject line "Refund Request – Platinum Member".

3. Refund Policy — Silver & Gold Members

Silver and Gold subscriptions are non-refundable once purchased. These tiers operate as fixed-period marketing packages, and the services covered (photography, listing placement, social campaigns) begin to be delivered immediately upon activation.

4. Listings & Content

You confirm that you are the lawful owner of the villa listed, or that you have authorisation from the owner to list and sell it. All photos, videos, and descriptions you upload must be accurate and your own (or licensed).

VillaForSale.co.in reserves the right to reject, edit, or remove any listing that is misleading, fraudulent, duplicate, or violates these Terms.

5. Verification & Use of Data

By signing up, you consent to OTP-based mobile verification. We use your contact details only to facilitate buyer-seller interactions and to send transactional updates. We do not sell or rent your personal data to third parties.

6. Limitation of Liability

VillaForSale.co.in is a marketplace platform — we facilitate connections between villa owners and prospective buyers. We are not a party to the final sale transaction and do not guarantee a sale, the conduct of any party, or the legal status of any property. All commercial agreements are between the buyer and the seller.

7. Dispute Resolution

Any disputes arising from these Terms shall be governed by the laws of India and subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.
